Since God is all powerful, is the absolute and sole master of men and the universe is the sovereign Lord, The Sustainer and Nourisher, The merciful, whose mercy encompasses all beings, Since He has given each man a human dignity and honours and breathed in him, his own spirit. He is the Doer of Whatever He Wills, When He wills a thing to be, He needs noone’s help, He has just to say to it, be! and it is
From the very blessing- The water which comes from the skies, The sky He has raised high. He has hung their-in the lamps of the sun and moon. Such instances are equally enjoyed by us irrespective of the religion, caste, colour or creed or sex. He created us and gifted us the power of speech and the power to think, Thus in the curt, all such gifted blessings are imperative which are unconditionally, unoversally and absolutely enjoyable to everyone under all circumstances and in all situations. It is binding without regard to the distinction of muslims and non muslims, the ruler or the ruled, the rich and the poor. Here it follows that human beings are united in and through him. According to Haditah, A person should be merciful to people on earth and God on high will be merciful to him. In this way Islam links personal salvation to serving others. One can recieve God’s reward in the hereafter only if one has done something to alleviate the sufferings of mankind.
As Islam posses a whole code for correct and right etiquettes, Thereby Islamic State may be setup in every corner of the earth. Islam doesn’t seek to restrict human rights or previllages to the geographical limits of its own state. Although Islam has laid down some universal fundamental rights for humanity as a whole. It was the reliasation of the biological unity of whole of the mankind that made Prophet (PBUH) to say in His night prayers
O God, I bear witness that all human beings are brothers (Nisai).
These laws sanctioned by God are meant to be observed, respected and followed under all circumstances whether such a person resides within the territory of the state or at war.
Everything man has, is given to him in trust by God or by man. In this way, everyone is bound by certain promises and obligations. Some obligations are entered into by written or spoken agreement, while others are a matter of tacit understanding, Whatever the form of agreement, man has to faithfully fulfill all these trusts and obligations. Meanwhile and in the same passion, rights sanctioned by God are part and parcel of the Islamic faith. Every muslim who claims himself to be a muslim will have to accept, recognize and enforce them. If anyways he fails to implement them or practically violate them while paving lip service to them, then the masage to them is mentioned in the Quran that they are disbelievers. More over if the laws may be accepted by non-muslims too, The cases of rapes, adulteration, forced labour, alcholoism, animal humiliation, innocent killings, etc has no way other than to disappear.
On all occasions and at every stage, the phrases of peace and mercy come readily to the lips of law followers. Thereby the whole life of believers is moulded by demands of mercy and compassion. In Islam it is not permissible to opress women, children, the old people, the sick or the wounded. Women’s honour and Chaisty are respected under all circumstances, Furthermore for women, The Quran says
You are the members, one of another (3:195)
Besides this the hungry must be fed, the naked to be clothed and the wounded or deserted to be treated medically irrespective of religion or whatever they belong to the Islamic state or amongst its enemies.
So in the view of above, the rights sanctioned by God may not be compared with the characters or resoulations of United Nations because the latter is not applicable to every believer.
Following are the Human Rights in Islamic state:-
|| Right of Life and property ||
All human beings whether believers or nonbelievers have right to live and noone is allowed to take the life of man without a plausible reason. The Prophet (PBUH) said about the non-muslims citizens of the muslim state, “One who kills a man in cold blood will not even smell the fragrance of heaven”
Furthermore Prophet (SAW) has also said “Your lives and properties are forbidden to one another till you meet your Lord on the day of judgement”
The holy Quran says,’
‘And don’t eat up your property among yourselves for vanities’
|| The protection of honour (Right to self respect) ||
If anyone defends his brothers honour in this world, Allah will shield his face from the fire on the day of resurrection (Trimidhi). Likewise it is enough evil for any person to despise his (or her) fellow muslim (Abu Dawood)
Here the Quran lays down 👇
a) Don’t insult anybody by using nicknames.
b) Don’t defame one another.
c) Don’t make fun of one another.
d) The honour and chasity of women is meant to be respected.
|| Right to freedom of speech and thought ||
Islam allows every person to express his difference with and criticism of his chiefs and rulers. Under the Islamic shelter, there is freedom of every desirable thought as well as respect for every thinking. Islam not only grant freedom of thought but also respects the upholders of schools of thought. During and after Prophet PBUH (period of Caliphs, anyone irrespective of his social status was allowed to explain his thoughts or speech and could freely criticize the Caliphs.
|| Freedom Of Expression ||
Islam endues the right to freedom of thought and expression to all citizens of the Islamic state on the condition that it should be used for the propagation of peace, virtue and truth and not for spreading evil and wickedness. Without the conception of social, cultural and political spheres, A person can enjoy freedom of expression, dissent and criticism without any fear of restriction. Under no circumstances would Islam allow any evil and wickedness to be propagated. Besides Islam doesn’t give anybody right to use abusive or offensive language in the name of criticism. During the era of Prophet PBUH, Muslims freely expressed their opinion and their viewpoints.
|| Right to protest against tyranny ||
Islam gives every right to a human being to protest against govt’s tyranny. This law could be easily sensed by the fact that was acknowledged by Hazrat Abu Bakr (RZ) in his first adress, who said
“Cooperate with me when i am right but correct me when i make error, don’t obey me when I deviate”
|| Right to belief ||
For this very right, The Quran says ”There shall be no coercion in matters of religion”, Any attempt to coerce a nonbeliever to accept Islam is a grevious sin
|| Right to relations ||
The teachings of Islam always stress the importance of society and the family in the life of one’s self. Prophet Muhammad PBUH has said “He is not perfect practitioner of closeness (to God) who does to his relatives as they do to him,’ But He is perfect who does good to them when they do it not to him” More over under this right an individual is commanded to do good and show kindness and liberty to his relatives and kinsfolk.
The Quran says, “Show kindness to your parents and your kinsfolk, to the orphans and to the needy, to the near and distant neighbors, to the fellow travellers, to the wayfarers and the slaves whom you own”
|| Freedom Of Association ||
Islam has also given people the right to freedom of association and formation of parties or organizations. However the right is subjected to the production of some general rules
|| Freedom of religious sentiments ||
Islam has endued every right to an individual to follow his religion and under this right, his religious sentiments shall be given due respect and nothing to be said/done which may encroach upon this right.
|| Protection of arbitrary imprisonment ||
For the take of this right, The Quran says, “No bearer of burdens shall be made to bear the burden of others” Besides Islam acknowledges the right to any fellow that he will not be arrested or imprisoned for the felony of others.
|| Equality before Law ||
Islam recognizes the right to an individual that he shall have complete equality in the eyes of law. The ruler and the ruled, the rich and the poor, black and the white is to be treated equally without any discrimination of caste, colour, political affiliation, race, sex or religion.
According to Prophet PBUH
“God does not bless a community in which the weak cannot take from the strong what is rightfully theirs without fear of reprisal”
In a very concise, Islam achieved the above mentioned human rights of which many others not only by providing certain legal safeguards but mainly by inviting mankind to transcend that lower level of animal life, is to be able to go beyond the mere ties, publicised through very thrivingness by the kinship of blood, racial superiority, linguistic arrogance, and economic privileges. It invites mankind to the absolute and perfect elysium. It provides an visionary approach for the mankind to just and superinduce from the very place of its existence, where the brilliance of man could reliaze the intact of the brotherhood of man. Moreover through its excellent and collosal vestrights, allows us to to comprehend the absolute just and from the very beam, man’s code of conduct has no way other than tended equity where everybody accepts that in this world of God, ‘There is no place for the path of injustice.’
